Terms of Service
These terms are the agreement between you and Stummy when you use the Stummy app or the stummy.app website. By using them you agree to these terms. If you don’t agree, please don’t use Stummy.
1. What Stummy is
Stummy is an eating-pace coach. You can photograph a meal, get a suggested pace, and follow timed bite cues. It also offers history, insights, reminders, a home-screen widget and a Live Activity. We may add, change or remove features over time.
2. Not medical advice
Stummy is for general wellness and mindful eating only. It is not a medical device and it does not diagnose, treat, cure or prevent any condition, or promise weight loss or any other health result. Paces and insights are general suggestions, not professional advice. Talk to a doctor or registered dietitian before changing how you eat, especially if you have a medical condition, a history of disordered eating, or feel unwell. If you think you have a medical emergency, contact your local emergency services.
3. Eligibility
You must be at least 13 years old (or older if your country requires), and have the legal capacity to agree to these terms. If you’re under the age of majority, use Stummy with a parent or guardian’s permission.
4. Your account and data
Stummy creates an anonymous account for you; there is no password to keep. Your data is handled as described in our Privacy Policy. You can delete your data at any time in Settings → Delete my data. Deleting the app alone does not delete your cloud data.
5. AI features
If you turn on photo analysis, the photos you take are processed by a third-party AI service to estimate texture and portion. AI results can be inaccurate or incomplete, so use your own judgement. You are responsible for what you photograph. Don’t submit photos of people, children, documents or anything you don’t have the right to share, or anything unlawful. You can turn photo analysis off at any time and still use Stummy with a standard pace.
6. Acceptable use
You agree not to:
- reverse engineer, decompile or attempt to extract the source code of the app, except where the law allows it;
- bypass scan limits, rate limits or other technical protections;
- use bots, scripts or automated means to access the service, or overload it;
- attempt to access other people’s data or interfere with the service’s security;
- use Stummy for anything unlawful, or in a way that could harm others or us.
7. Our content and your content
The Stummy app, name, logo, mascot, artwork, text and software belong to us or our licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal use.
You keep ownership of the content you provide, such as your meal photos and logs. You give us a limited licence to process it only as needed to run Stummy for you, as described in the Privacy Policy. Feedback you send us may be used by us without obligation to you.
8. Availability and changes
We aim to keep Stummy running but it is provided on an as-is basis and may be unavailable from time to time, for example during maintenance or because of a provider outage. We may apply daily limits to meal scans. We may change or discontinue parts of the service; if we make a change that materially affects you we’ll try to give notice.
9. Apple App Store terms
If you got Stummy from the Apple App Store, you also agree to Apple’s Licensed Application End User License Agreement. In particular: these terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support for the app; and Apple is a third-party beneficiary of these terms and may enforce them against you. Questions, complaints and claims about the app are handled by us, at the contact below.
10. Disclaimers
To the fullest extent the law allows, Stummy is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don’t warrant that the service will be uninterrupted or error-free, or that it will produce any particular result.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of Stummy. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us for it in the 12 months before the claim (if any) and EUR 50. Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, fraud, or your statutory consumer rights.
12. Ending use
You can stop using Stummy at any time and delete your data in the app. We may suspend or end your access if you break these terms or misuse the service. Sections that by their nature should continue (such as ownership, disclaimers and liability) will survive.
13. Governing law
These terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-law rules. If you’re a consumer, you also keep the mandatory consumer-protection rights of the country where you live, and you may bring a claim in your local courts.
14. Changes to these terms
We may update these terms. We’ll change the date at the top, and for material changes tell you in the app or by email. If you keep using Stummy after the changes take effect, you accept the updated terms.
